What reforms are being considered for measure 11 crimes?

As many Oregon residents are aware, some criminal charges have defined penalties attached to them. In some cases, mandatory minimum sentences apply, ensuring that those defendants convicted of a felony face the appropriate penalties for the crimes he or she committed. While this helps guarantee that offenders of serious crimes receive their necessary punishment, this also presents a problem for some defendants facing felony allegations. Specifically, mandatory minimum sentences could result in harsh penalties that do not adequately fit the crime.

Back in 1994, Oregon voters passed Measure 11 in order to establish mandatory minimum prison sentences for specific crimes; however, after over 20 years,Measure 11 crimes are being given a second look to determine if a reform is necessary. Those rallying against Measure 11 claim that "time does not fit the crime," especially for first time offenders.

What reforms are being considered for measure 11 crimes? Because the fact that an offender is a first time offender is not taken into account for Measure 11 crimes, changing this system could initiate meaningful criminal justice reform. In addition to giving first-time offenders a chance, opponents of Measure 11 are speaking out on the need for time off for good behavior.

Because Measure 11 has provided some good and much structure to the criminal justice system, many do not want to see changes to it to get out of control. Therefore, reformers may have to take measured steps in trying to change the law.

Measure 11 covers first and second-degree violent crimes and sex offenses; therefore, those accused of these crimes in Oregon are likely to face serious penalties if convicted. Defendants facing serious charges, such as a Measure 11 crime, should take the time to understand what criminal defense options are available to them. This could help the accused to get the best possible disposition of their criminal case.
