For many people in Oregon, driving is an everyday task. It is how people get to work, school and social events. However, a person's car can also be the source of legal trouble. While simple infractions can lead to traffic violations -- such as speeding tickets -- driving can also lead to much more serious criminal charges. Oregon residents should be aware of the possibility of more serious charges when getting behind the wheel. Generally, criminal charges fall into two categories -- misdemeanors and felonies. Misdemeanors are less serious than felonies. Misdemeanor driving offenses may require a person to pay a fine or spend some time in jail -- if convicted. If a person is accused of a misdemeanor traffic offense, that person will be arrested and may have to post bond to be released from jail. Common misdemeanor traffic offenses include driving without insurance, failing to stop following a car accident and reckless driving. Driving without a valid license is also a common misdemeanor.
Additionally, driving under the influence of drugs or alcohol can be a misdemeanor charge as well. However, DWI or DUI charges are felony charges, in some situations. For example, repeat DUIs can be charged as felonies, as well as other aggravated situations where people are hurt while a driver is drunk.
Felony traffic offenses generally occur when more serious crimes occur. These crimes carry stricter penalties, including larger fines, longer jail or prison sentences and the loss of other rights. Common felony traffic offenses, in addition to the DUI-related offenses, include hit-and-run and vehicular homicide.
People need to be aware of these potential criminal charges. If people face these charges, an attorney can explain their rights. Often, a comprehensive criminal defense strategy is necessary -- even for those facing misdemeanor charges.
