Types of evidence in a criminal charge

Everyone makes mistakes from time to time. When these mistakes involve criminal behavior, people face serious consequences. However, in order for a person to face penalties from criminal charges, they must be convicted. In the United States, people can only be convicted of a criminal charge if there is evidence that proves the person is guilty of the crime beyond a reasonable doubt. In order to do this, prosecutors must have the right evidence.

There are many types of evidence that can be used in criminal cases to convict an Oregon resident. The first type of evidence is called testimonial evidence. This is evidence that is given directly to the court. Another type of evidence is documentary evidence. This is evidence that has been preserved in document form. This could include letters or other documents pertaining to the facts of the case.

The third type of evidence is called demonstrative evidence. Demonstrative evidence includes physical demonstrations that portray the event. This could include a model of what may have had happened at a particular time. Finally, there's real evidence. Real evidence includes tangible objects that can be used to prove that a crime occurred. This could include things like the weapon used to carry out a crime.

In criminal case, a variety of evidence is likely to be used against a defendant. However, defendants should know that there are certain types of evidence that are limited in court. For example if the evidence was illegally collected, it can be barred from use in a criminal trial.

Most people do not know enough about evidence to distinguish between what might be permissible at trial and what might not be. Therefore, people who are facing charges need the help of an experienced criminal defense attorney to root through the evidence in the case. The attorney understands the rules of evidence that apply in a particular case and can use the evidence presented by the prosecutors as part of a criminal defense strategy.
