When is marijuana delivery a misdemeanor in Oregon?

Oregon is one of many states in the United States that has recently changed its marijuana laws. These laws make the use of marijuana legal within the state. However, there are still many restrictions surrounding the sale of marijuana and of other types of drugs. In many cases, people can face criminal charges for dealing marijuana.

Because the laws within the state are changing, it is important for people to know and understand their legal rights. In some cases, the delivery of marijuana can result in misdemeanor or felony charges. While this blog post can only provide information, an attorney can help answer specific legal concerns. One concern can include -- when can people face misdemeanor charges for the delivery of marijuana?

Under O.R.S. section 475.860, the delivery of marijuana can be a misdemeanor in a couple of situations. One, it can be a Class A misdemeanor when less than on avoirdupois ounce of the plant is given to another person without consideration.

If the unlawful delivery of marijuana was to a person over the age of 18, takes place within 1,000 feet of a school attended by minors, is less than five grams of dried Cannabis plant -- the flowers, stem or leaves -- and there is no consideration, then the unlawful delivery is a Class C misdemeanor.

These low-level drug charges can still carry serious penalties. They can affect a person's future schooling and employment prospects, lead to jail time, fines and more. In this situation a criminal defense strategy can help people avoid penalties. An attorney may be helpful for people facing misdemeanor drug charges.
