Driving under the influence is an easy mistake to make. If a person has a drink or two, it can be easy to over indulge and not even realize it. However, this simple mistake has very serious consequences.
Oregon residents who are convicted of driving under the influence of intoxicants face serious criminal penalties. These penalties can include large fines, jail or prison time, community service, a driver's license suspension, mandatory alcohol education classes, an ignition interlock device and more. These criminal penalties can affect a person for years after the person's arrest.
In addition to these criminal penalties, there can be social penalties as well. For example, people can face consequences for DUII convictions at their work.
In a recent case, a Portland fire captain has been demoted following a DUII arrest. According to reports, the recent incident is the man's third DUII. As a result, it was announced that he would be demoted to firefighter from captain. Officials from the fire department said that this was just one step short of terminating the man altogether. They announced that if the man is arrested again for DUII in the next five years, then he would be immediately terminated.
As a result of this case, the Portland Fire and Rescue Department is creating a policy to deal with employees who have been arrested for drunk driving. Prior to this case, no such policy existed.
Because of the serious charges and consequences that accompany drunk driving, people need to protect their legal rights. With the right help defenses to driving charges can be asserted in court. These defenses may make it possible to reduce the charges or eliminate them altogether.
