In a large city like Portland, people are likely to see cigarette butts all the time on the sidewalks and roadways. Smokers may not think twice about disposing of their cigarettes outside. In fact, most people have probably seen other people thrown their cigarettes out of the window of a car. However, what people may not know is that doing this breaks Oregon state law.
Under Oregon law, it is a class B misdemeanor to throw a lighted cigarette butt out of a car window. This law applies whether or not the person is on a public or private road or a highway. The rule also applies in Oregon's cities and out in the country. Finally, the rule also applies while on a railway in the state of Oregon.
If a person breaks this law, then that person can face punishments. A guilty sentence for this class B misdemeanor includes up to six months in jail and a $500 fine. These are significant punishments for littering. Police say that they are concerned about these cigarette butts starting fires - especially in dry months - which is why the punishments are so significant. If the cigarette butt did start a fire, a person could face additional criminal charges and penalties.
Like with many misdemeanor charges, people may not think the conduct is such a big deal until they realize the consequences that accompany those charges. While the punishments are not as severe as some crimes, they can still cause financial hardship and disrupt a person's professional and personal lives.
To avoid these penalties, even those charged with misdemeanors should take their criminal defense seriously. In these cases, defenses may be available that can reduce charges or limit punishments. In any case, people should make sure their basic constitutional rights are protected.
