Oregon man granted new criminal trial

Many Oregon crimes result in severe penalties if a person is found guilty. Therefore, an aggressive criminal defense is very important. Without the right criminal defense strategy and help, people can face unnecessary punishment.

One Oregon man has recently won the right to new criminal proceedings after showing that his original defense team did not advocate appropriately for him. In his case, the man was sentenced to death after he was found guilty of rape and murder.

The man was charged in 2001 after a girl's body was found. The man was accused of drugging the girl, raping her and then throwing her body over a bridge. According to the man, his former defense attorney's defended him on a technical point about jurisdiction. They claimed that he could not be found guilty in the court since the alleged murder took place in another county.


However, according to the man these attorneys never tried to corroborate the man's version of the story. The man claims that he found the girl dead in his apartment after she had overdosed on drugs. His former attorneys never ordered toxicology reports on the girl's body or searched for other evidence to back up his story. The man argues that a reasonable attorney would have conducted these tests and investigated the case further.

After the man was found guilty, he appealed his case. His first appeal was denied. However, a judge has recently agreed to a new trial after another appeal since his attorney did not provide adequate representation.

Those who are accused of felony crimes face an uphill battle to clear their name and return to a normal life. However, everyone deserves a chance to protect their constitutional rights and defend against criminal charges. With the right representation, people can have a better outcome.
