In many states, including Oregon, the state has permitted the use of medical marijuana. Therefore, in Oregon, it is legal to use marijuana as a registered user. There are 54,200 people who are eligible grow and use medical marijuana in Oregon. It is, however, illegal to sell medical marijuana in Oregon, even to registered users. If users sell marijuana, then they can face drug charges.
One Oregon man has recently been arrested after a raid of his property for allegedly selling marijuana. This man ran a medical marijuana distribution center. The center and two of his personal properties were raided. Two additional properties were also searched in the investigation. Police claim they had search warrants for each of the searches.
During the raid, police confiscated marijuana plants, processed marijuana and food they believed contains marijuana. Police are claiming that this man was selling to members of his distribution center. According to police, a police informant purchased medical marijuana from the center on four different occasions. In addition to the drug charges, police have also accused this man of money laundering since he is not employed in Oregon but has purchased property worth over $300,000.
This man denies the charges and claims that his properties were illegally searched. He claims that any money that exchanged hands at the distribution center was to recoup costs associated with growing the marijuana -- which is allowed under Oregon law.
This case illustrates the fine line that can be created in medical marijuana cases. If this man is found guilty on these charges, he could face serious penalties. If he believes the searches are illegal, he will need to fight to ensure his constitutional rights are upheld and any illegally collected evidence is excluded from the courtroom.
