Can you sell drug equipment in Oregon?

There are people across the state of Oregon who buy and sell goods on a daily basis. Many individuals make a living by selling products to other consumers. Many people may not think about what they are selling or the legal ramifications of certain products. However, it can be important for those selling certain types of equipment to understand the legal realities that can follow.

In particular, if an individual is selling drug equipment, there are criminal laws that can come into play. Specifically, under section 475.960 of the Oregon criminal code, it is illegal for someone to sell drugs equipment under certain conditions. If the individual knows that the consumer will use the drug equipment to convert, compound, prepare or manufacture a controlled substance, then the person can face criminal charges for illegally selling drug equipment.

Drug equipment, under this section, includes a substance, apparatus, device or article that can be used in the situations. If a person faces charges for illegally selling drug equipment, the person can be convicted of a Class A misdemeanor.

Misdemeanors can be accompanied by a variety of penalties. These include fines, jail time and more. These consequences can follow a person and make certain aspects of the person's life difficult. Therefore, it is important for people who may own things that can be used for the production for distribution of drugs to be aware of the rights. While this blog post can only give general information about misdemeanors in Oregon, an attorney can help to guide individuals who are facing low-level drug charges.
